    4. Refunds & Cancellations
    All session fees and deposits are non-refundable. If you need to reschedule a session, you must notify us at least 48 hours in advance.     While we strive for accuracy, we do not guarantee that all information on our website is error-free. We are not liable for any direct or indirect damages resulting from website use.

    Products ordered through Michael Davis Photography are produced using a high-quality professional lab. We accept no liability for the quality of products printed by third-party suppliers when digital files have been provided to the Client with a print release.

    6. Digital Image Usage
    Clients receiving digital images are granted a personal-use license. Images may not be altered, edited (other than cropping for personal use), or used for commercial purposes without written permission. Michael Davis Photography retains all copyrights unless explicitly transferred.

  • THIS AGREEMENT is made as of the date of booking between the Client and Michael Davis Photography (‘Michael Davis’) for the purpose of providing professional photography services as outlined in the terms below.

    1. Upon successful session fee or deposit receipt, Michael Davis shall reserve the time and date agreed upon.
    2. Michael Davis will wait at the pre-agreed location or the studio for a maximum of 10 minutes after the agreed start time. Should the Client fail to arrive, the session will be treated as a cancellation without notice and full deposit will be retained by Michael Davis.

    3. Cancellation of sessions for whatever reason must be stated in writing no less than 48 hours prior to the start date and time of the pre-agreed session.

    4. All session fees and deposits are non-refundable, even if the portrait is rescheduled or cancelled for any reason other than inclement weather.

    5. Session fees must be paid at the time of booking. Preview images will not be available until the session fee has been paid in full. No part of any order, including digital images, will be delivered until the order balance has been paid in full. Following the session, the Client is required to purchase one of the available photography packages. Pricing and package details will be provided before the session.

    6. Michael Davis reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Michael Davis in the event of litigation arising out of such use.

    7. Negatives, digital files and previews remain the exclusive property of Michael Davis.

    8. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Michael Davis, the Photographer may elect to use an alternate location or to reschedule the session.

    9. If Michael Davis cannot perform this Contract due to fire or another casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Michael Davis’s illness or emergency, then the Photographer shall return any session fees or deposit to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that Michael Davis fails to perform for any other reason, Michael Davis shall not be liable for any amount in excess of the retail value of the Client’s order.

    10. The Client is responsible for protecting and caring for his/her printed and/or digital products. Michael Davis is not responsible for any damaged products after successful delivery of said products.

    11. Products ordered through the Photographer(s) are produced using a high-quality professional lab. The Photographer(s) accept no liability for the quality of products produced using third-party suppliers, where digital files have been provided to the Client with a print release.

    12. The charges in this Contract are based on Michael Davis’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

    13. Following the session, the client is required to purchase a collection before making any additional purchases. (If you are genuinely dissatisfied with your images, please contact Michael Davis to discuss possible solutions).

    14. This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties.

    To proceed with your booking, you must read and agree to the terms outlined in this Agreement. By submitting payment, you confirm that you have read, understand, and agree to be bound by these terms and conditions.

  • 1. Promoter:

    This raffle prize voucher is issued by Michael Davis Photography (“Promoter”, “we”, “our”, or “us”) located in Lordswood, Kent, UK.

    2. Voucher Validity:

    The voucher is valid for 6 months from the date of the prize draw or announcement, unless otherwise stated. The session must be booked and completed within this period. Expired vouchers will not be accepted.

    3. Non-Transferable & No Cash Value:

    The voucher is non-transferable and can only be redeemed by the named winner. It may not be sold, gifted, exchanged, or transferred without prior written authorisation from Michael Davis Photography.

    • The voucher has no cash value and cannot be exchanged for monetary compensation or alternative services.

    4. Session Agreement Applies:

    By redeeming the voucher, the winner agrees to the Michael Davis Photography Session Agreement, which outlines the terms of service, cancellation policy, and image usage rights. The full agreement will be provided prior to the session.

    5. Booking & Availability:

    The voucher entitles the winner to a standard outdoor dog photography session, as specified in the raffle or promotion description.

    • Bookings are subject to availability. It is recommended to book early to secure a preferred date.

    • Sessions must be scheduled at least 48 hours in advance.

    6. Session Inclusions:

    The prize covers the session fee and may include a complimentary print or digital image, as detailed in the raffle description.

    • Additional images, prints, or products are available for purchase separately at standard rates.

    7. Rescheduling & Cancellations:

    • The winner may reschedule the session once with at least 48 hours’ notice, subject to availability.

    • Failure to attend the session without prior notice will result in the voucher being void.

    8. Weather Policy:

    In the event of inclement weather or conditions unsuitable for the session, Michael Davis Photography reserves the right to reschedule the session to a mutually agreed date and time.

    9. Liability & Image Usage:

    • Michael Davis Photography retains the copyright to all images and may use them for promotional purposes (including social media, website, and marketing materials), unless the winner explicitly requests otherwise in writing.

    • The winner is granted a personal-use license for any digital images included, which may not be used for commercial purposes without written permission.

    10. Third-Party Products & Services:

    • Products ordered through Michael Davis Photography are produced using a high-quality professional lab. We accept no liability for the quality of prints or products produced by third-party suppliers if the winner chooses to print digital images independently.

    11. Right to Modify or Withdraw:

    Michael Davis Photography reserves the right to modify or withdraw this voucher offer at any time without prior notice.

    12. Governing Law:

    These terms and conditions are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.

  • 1. Definitions

    • Referrer: An existing client of Michael Davis Photography who shares their unique referral link with others.

    • Referred Client: A new client who books their first full-priced session through a referrer’s unique link.

    2. Eligibility

    • Who Can Participate:

    • The referral program is open to all existing clients of Michael Davis Photography.

    • Clients must have completed at least one full-priced session to be eligible to refer others.

    • Who Can Be Referred:

    • Referred clients must be new customers who have not previously booked a session.

    • A referred client can only claim the referral discount for their first session. They cannot use referral discounts again for future bookings.

    • However, referred clients can become referrers and earn discounts by successfully referring new clients.

    • Reasonable Referral Limit:

    • While there is no strict limit on the number of referrals a client can make, the program is intended for personal use only.

    • Excessive or commercial referral activity may be disqualified at the discretion of Michael Davis Photography.

    • Employee Exclusion:

    • Employees, contractors, or collaborators of Michael Davis Photography (if applicable) are excluded from participating in the referral program.

    3. Referral Process

    • How to Refer:

    • After their session, every client will receive a unique referral link featuring their dog’s name

    • The referred client must book through this link for the referral discount to be valid.

    • Information Required:

    • The referred client must provide their contact details when booking, and confirm the referrer’s name if requested.

    • Referral discounts must be stated at the time of booking. Discounts cannot be applied retroactively.

    • Referral Tracking:

    • Referrals are tracked using the unique referral links and verified against booking records.

    • If multiple referrers claim the same client, the discount will be granted to the first valid referrer recorded.

    • Referral Validity:

    • A referral is only valid if the referred client completes a full-priced session.

    • If the referred client cancels or does not attend, the referral discount is void.

    4. Rewards and Incentives

    • Reward Amount:

    • Both the referrer and the referred client will receive:

    • £20 off the full session fee.

    • 10% discount on digital and print packages purchased.

    • Redemption Rules:

    • The referral discount is only valid for full-priced photography sessions and cannot be used for mini sessions, discounted packages, or special offers.

    • The referrer’s discount can only be applied to their next future session and cannot be used for sessions that have already taken place.

    • Only one referral discount can be applied per session. Discounts cannot be combined or stacked.

    • Issuing the Reward:

    • The referred client’s discount is applied to their first session at the time of booking.

    • The referrer’s discount is applied to their next session once the referred client’s session is completed and paid.

    • Multiple Discounts:

    • Referrers can earn multiple discounts by successfully referring different clients.

    • Each discount applies to a future session on a one-per-session basis.

    • No Expiry on Rewards:

    • Referral discounts do not expire and remain valid for future bookings.

    • All sessions booked through the referral program are subject to Michael Davis Photography’s standard session agreement and general terms and conditions.

    • By participating, clients agree to comply with these terms.

    • The referral program is governed by applicable UK laws and regulations.

    • Privacy and Data Usage:

    • By participating, both referrers and referred clients agree to the collection and use of their personal data (e.g., name, contact information) for the purpose of tracking and applying referral discounts.

    • Personal data will be handled in accordance with Michael Davis Photography’s Privacy Policy.

    • Prohibited Activities:

    • Referrals obtained through spam, fraudulent activity, or misleading claims will be disqualified.
